The punishments for a first offense DUI are as follow:

Possibility of jail time up to six months
Driver’s license revoked or suspended for six months
Mandatory alcohol educational class
Mandatory alcohol assessment and treatment
Possible deportation for non-US citizens

Fines ranging from $500 – $2000

What are the penalties for a second offense DUI?

The punishments for a second offense DUI are as follows:

Mandatory 10 day jail time, which could be extended up to nine months at the judge’s discretion. If your blood alcohol level is above 0.15 it can be extended for one year.
Drivers license revoked or suspended for a year up to five years
One year wait to obtain a hardship driver’s license
Attend mandatory alcohol educational class
Attend mandatory alcohol assessment and treatment
Vehicle confiscated for a minimum of 10 days
Possibility of the mandatory installation of a feature that would require you to take a breathalyzer test in order for your car to start, called the ignition interlock device, which is quite costly
Fines ranging from $1000 – $4000
Up to a year probation
Mandatory community service
Higher insurance rates
Possible deportation for non-US citizens

What are the penalties for a third DUI, felony DUI and/or a DUI with serious bodily injury?

The penalties for a third DUI, felony DUI or a DUI with serious bodily injury are as follows:

Jail is a mandatory 30 days with a five year sentence possible.
Fine is from $2000 to $5000
Driver’s license revoked or suspended for two years
Attend mandatory alcohol educational class
Attend mandatory alcohol assessment and treatment
Possibility of automobile being impounded and the possibility of the mandatory installation of a feature that would require you to take a breathalyzer test in order for your car to start.

What is the penalty for causing death during a DUI?

The penalties for causing a death while driving under the influence are severe. If you are convicted of killing someone while under the influence of alcohol, the penalties and fines can be significant and you can also face significant jail time.

When can a DUI be a felony?

When you receive a third DUI within a 10 year period of receiving the first or second DUI or when you are driving under the influence and cause serious bodily harm or death to another.
